Mediation of Oil & Gas and other Complex BUsiness Disputes
We conduct mediations either in-person or virtually. Unless the parties cannot agree, in-person mediations will be conducted at Permian Mediation's office or at the law office of one party's attorney. Otherwise, in-person mediations will be conducted at a neutral conference center for an additional charge.
Our fee depends on the complexity of the case and will be determined when the mediation is scheduled. Generally, our Base Fee is $2,750 per party, per day for a full-day mediation. If the matter is particularly complex, the Base Fee will be adjusted accordingly. In most cases, the Base Fee includes the mediator's time to prepare for the mediation, including review of pre-mediation materials presented by each party and pre-mediation consultations with each party's attorney.
Generally, all parties represented by a single attorney are consider a single "party" for fee purposes. If one or more parties is similarly aligned such that neither they nor their attorneys require a separate room, then such parties will generally be considered a single "party" for fee purposes. However, Permian Mediation reserves the right to alter party status for fee purposes if the parties become no longer aligned, or if parties require a separate room, as the mediation progresses.
A full-day mediation is 8 hours and typically starts at 9:00 a.m. and concludes at 5:00 p.m. If a mediation does not conclude by its allotted time, then an additional fee may be added to the Base Fee and split evenly among each party.
Additional charges for required travel time and expenses, costs for renting a neutral conference center, and meal/refreshment expenses may be added to the Base Fee and will be discussed with each party when the mediation is scheduled.
Unless other arrangements have been made with the mediator, the Base Fee is due no later than the commencement of the mediation.
Permian Mediation has the in-house ability to work with a Consultant Mediator who is a subject-matter, Board Certified expert. The decision whether to retain the Consultant Mediator will be made in consultation with each party's respective attorney. The fee for the Consultant Mediator will be determined when the mediation is scheduled.
The fee for Chris to serve as an arbitrator will be determined at the time of engagement based on the complexity of the case. Unless otherwise agreed by the parties or, if appropriate, determined differently in the Arbitrator's Award, the fee will be split evenly among the parties. Additional charges for required travel or for rental of an arbitration hearing location will be discussed with each party when the arbitration is scheduled.
